Rights of Persons Deprived of Their Autonomy

Abstract:

Omezení svéprávnosti představuje závažný zásah do práv člověka a je označováno za krajní řešení. Soudy by měly preferovat alternativní možnosti podpory, přesto k omezení svéprávnosti dochází stále hojně. Práce je rozdělená do dvou částí. Teoretická část obsahuje rozbor základních pojmů a relevantní právní úpravy. Druhou část práce tvoří především analýza judikatury Nejvyššího a Ústavního soudu. Pozornost je věnována případům, ve kterých soudy favorizovaly omezení svéprávnosti, aniž by toto rozhodnutí dostatečně zdůvodnily. V závěru nechybí úvaha, jak užití tohoto institutu minimalizovat.

Abstract:

Restriction of legal capacity represent a serious intervention into human rights, and it is established as a last resort solution. Courts should prefer alternative options of support, despite this, there is still much restriction of legal capacity. The thesis is divided into two parts. In the literary part, fundamental terms and relevant legal regulations are analysed. The second part of the thesis deals primarily with the analysis of the Supreme Court’s and The Constitutional Court’s judicature. The attention is paid to cases, in which the courts favoured the restriction of legal capacity without justifying their decision to do so enough. Contemplation about the way of minimalizing the use of this institute does not miss in the conclusion of the thesis.
