Abstract:

Cílem diplomové práce je především snaha popsat současnou právní úpravu nepominutelného dědice a jeho vydědění. Popsat změny, které nastaly s novou právní úpravou a pokusit se o co nejsystematičtější pojetí této části dědického práva. Text diplomové práce je rozčleněn do třech kapitol, které jsou dále děleny do jednotlivých podkapitol. První kapitola je věnována vymezení pojmu nepominutelný dědic, právu na povinný díl a dalším právům, stejně tak jako postavení nepominutelného dědice v řízení o pozůstalosti. Samostatná podkapitola je věnována právu na zaopatření. Povinný díl je obsahem druhé kapitoly, kdy povinný díl představuje právo nepominutelných dědiců. Tato kapitola je věnována pojmu povinný díl, jeho velikosti, výpočtu, zápočtu a následné výplatě. Poslední, třetí kapitola je věnována vydědění. Je zde snaha popsat důsledky vydědění a toho, jaké náležitosti musí obsahovat prohlášení o vydědění. Samostatné podkapitola je zaměřena na vydědění mlčky a po právu a negativní závěti. Jednou z nejdůležitějších podkapitol je podkapitola obsahující zákonné důvody vydědění. Závěr diplomové práce je věnován dalším způsobům vyloučení nepominutelného dědice z jeho dědického práva, tedy zřeknutí se práva, odmítnutí či vzdání se dědictví.

Abstract:

The aim of this thesis is mainly to describe the current legislation forced heir and disinheritance. Describe the changes that have occurred with the new legislation and to attempt what most systematic approach to this part of the law of succession. The text of the thesis is divided into three chapters which are further divided into individual sections. The first chapter is devoted to the definition forced heir, the right to legitime and other rights, as well as the position of forced heir, the management of the estate. A separate section is devoted to the right to maintenance. Legitime the contents of the second chapter, which represents the right legitime not be ignored heirs. This chapter is devoted to the concept legitime, its size, calculating, credit and subsequent payday. Finally, the third chapter is devoted to disinheritance. There is an effort to describe the consequences of disinheritance and what requirements must include a declaration of disinheritance. Separate section is focused on disinheritance silence and rightly wills and negative. One of the most important subchapters containing the legal reasons for disinheritance. The final section is devoted to the exclusion of other ways forceed heir of his inheritance law, a waiver or refusal or renunciation of inheritance.
