Abstract:

Diplomová práce pojednává o efektivitě rozhodčího řízení. Popisuje právní aspekty rozhodčího a soudního řízení z pohledu procesu vzniku sporů mezi subjekty, podmínek omezujících vydání rozhodčích nálezů a platebních rozkazů a navzájem je porovnává. Průzkum je zaměřen na efektivitu z hlediska časového, z hlediska nákladů věřitele na řízení, a také z hlediska rychlosti návratnosti finančních prostředků věřiteli. Závěr práce poukazuje na možná zlepšení a nachází východiska, jak zefektivnit proces vykonatelnosti a vymahatelnosti rozhodčích nálezů v ČR.

Abstract:

Evaluation of the effectiveness of arbitration as a tool of resolving property disputes.This thesis discusses the effectiveness of the arbitration. It describes the basic legal aspects of the arbitration and the trial process from the perspective of disputes between parties but also from the perspective of the restrictive conditions of issuing of arbitrament and payment orders and compares them with each other. The survey focuses on efficiency, which is assessed in terms of time and cost management for the creditor, and also in terms of rate of return of funds to the creditor. The conclusion suggests possible improvements and ways of streamlining the process of operation and enforceability of arbitraments in the country.
