Abstract:

Předmětem bakalářské práce „Činnost Kanceláře finančního arbitra“ je přiblížení pravomocí a působnosti finančního arbitra a úkolů s výkonem jeho činnosti spojených. První část je zaměřena na seznámení se všemi souvisejícími pojmy a zákonem o finančním arbitrovi, který pojednává o subjektech účastnících se sporů, o kterých finanční arbitr rozhoduje, o úkolech příslušejících arbitrovi a jeho zástupci, dále o arbitrovi samotném, jeho zástupci a dalších zaměstnancích tohoto institutu, o průběhu řízení před arbitrem a jeho náležitostech a o rozhodnutí. Je zde taktéž pojednáno o námitkách spojených s nálezem. Nedílnou součástí je také objasnění informační povinnosti jak finančního arbitra, tak i institucí. Důležité je také pojednání o pokutách a sankcích, které arbitr uděluje při nesplnění určitých povinností. Druhá část je věnována praktickým případům, které spadají pod odbornost finančního arbitra. Několik případů je zde také dopodrobna rozebráno. V této části je přiblížen i obsah výročních zpráv a zpracované statistiky z těchto informací. V závěru je shrnuta užitečnost instituce finančního arbitra v současnosti a využívání tohoto druhu „pomoci“ poškozenými spotřebiteli.

Abstract:

The subject of the Bachelor’s Thesis “The activity of financial arbitrator´s office” is an examination of the authority and jurisdiction of the financial arbitrator and the tasks associated with the performance of his or her activities. The first section is focused on familiarisation with all associated terms and with the Act on Financial Arbitration, which discusses the subjects involved in disputes on which the financial arbitrator will issue rulings, as well as the tasks pertaining to the arbitrator and his or her representatives, the arbitrator himself or herself, the arbitrator’s representatives and other employees of the institution, the course of proceedings before the arbitrator and their requirements, and the issue of rulings. Here objections associated with the findings are also discussed. An inseparable part is also the clarification of the information obligations of both the financial arbitrator and the institution. The discussion of fines and sanctions assigned by the arbitrator following the non-fulfilment of certain obligations is also important. The second section is devoted to the practical cases that fall under the expertise of the financial arbitrator. Several cases are also discussed in detail. In this section the contents of annual reports and statistics processed from this information are also examined. The conclusion summarises the usefulness of the institution of the financial arbitrator in contemporary times and the use of this form of “help” by injured consumer parties.
