Direct presidential election in the Czech Republic - analysis of the first case

Abstract:

Hlavním cílem této bakalářské práce bylo zanalyzovat historicky první případ přímé volby prezidenta v České republice. V této práci jsme si zpočátku vysvětlili jednotlivé kroky, díky kterým k zavedení přímé volby prezidenta republiky v České republice došlo. Na základě této analýzy jsme zjistili, že hlavními důvody k jejímu zavedení byla inspirace u nejbližších sousedů České republiky, Polska, Rakouska, Slovenska, rostoucí poptávka obyvatel a zejména problémy spojené se zvolením českého prezidenta při volbách 2003 a 2008. V práci jsou uvedeny jednotlivé návrhy, které změně zákona o přímé volbě prezidenta republiky předcházely. Návrhy byly předkládány jednotlivými politickými stranami a jeden z návrhů byl předložený vládou. V práci se dozvídáme o názorech odborníků, kteří se stavěli spíše proti zavedení přímé volby a poukazovali na možné nežádoucí dopady. Poté se dostáváme k uvedení přímé volby do praxe v prezidentských volbách, které se konaly v lednu 2013, kde jsme nastínili její nejdůležitější momenty. Na základě analýzy voleb se dozvídáme o příčinách, které vedly k vítězství Miloše Zemana, který se stal prvním přímo zvoleným prezidentem České republiky. Ten si ke svému vítězství dopomohl hlavně způsobem vedení své kampaně a díky svému charisma. Jelikož se jednalo o první přímé prezidentské volby, nelze z nich vyvodit výrazné nežádoucí dopady, na které mnozí odborníci upozorňovali. V kompetencích prezidenta nenastaly po zavedení přímé žádné výrazné změny. Ztížen byl způsob prezidentova odvolání.

Abstract:

The main goal of my bachelor's work is to analyse the historically first case of the direct Presidential Election in the Czech Republic. At the beginning of my work, I explained the constituent steps, which where essential to the implementation of the direct election of the Czech Republic President. On the base of the analyses, I present that the main reasons for such step were three aspects. First, it was an inspiration from the nearest neighbours of the Czech Republic which means Poland, Austria and Slovakia. Second, growing demand of inhabitants and third, the huge problems connected to Czech President Election in 2003 and 2008. There are mentioned the proposals which led to direct President Election, in my work too. I mention representative experts´ opinion that was rather against such an implementation and pointed out to some possible unwanted effects. I continue in describing the transformation into the real life in the election in January 2013. My work further shows the hottest moments from the last Presidential Election. On the base of election analysis, the reader can find out the most important reasons, which led to the victory of Milos Zeman, who afterwards became historically the first directly elected Czech Republic President. The analyses say that the victory of Milos Zeman was basically caused by the leading of his campaign, his charisma and his experience. Because the experts who were against the direct Presidential Election, were against such election itself, we can´t summarize only from this first election, if they were right or not. The President authority in the Czech Republic has not gone through any radical changes. Nevertheless, the removing of the President from the office has been transformed and is more difficult now. My work also introduces particular needs in the code which occurred during the elections. It is believed now that the main problem was the registration of the list of candidates. This and some other needs should be eliminated before the next elections in 2018.
