Legislative changes during the energy crisis in the context of consumer protection

Abstract:

Diplomová práce se zabývá mapováním legislativních změn v oblasti energetiky v době energetické krize. Energetická krize, která vznikla kombinací několika faktorů (nehospodárné zacházení se zdroji energie ve střední Evropě, válka na Ukrajině a s tím související vzájemné sankce mezi Evropou a Ruskem), si vyžádala legislativní opatření, jejichž cílem bylo zmírnit dopady růstu cen energií na domácnosti. Práce má v první části objasnit, kdo je účastníkem na trhu s elektřinou a plynem a jaká je stávající legislativa v oblasti ochrany spotřebitele. Druhá část bude věnována energetické krizi jako takové, dopadu na účastníky trhu a řešení ze strany státu s cílem ochránit spotřebitele. Zde se budu věnovat zejména analýze nástrojů schválených vládou v období let 2022 a 2023 v podobě úsporného tarifu, plošného zastropování cen energie pro domácnosti a úpravou uzavírání smluv se spotovou cenou. V této souvislosti se pokusím vyhodnotit, jak se výše uvedené legislativní změny promítly do praxe a jaký dopad v konečném důsledku měly na účastníky trhu s elektřinou a plynem.

Abstract:

The thesis charts the legislative changes in the energy sector during the energy crisis. The energy crisis, which was caused by a combination of several factors (wasteful use of energy resources in Central Europe, the war in Ukraine and the related mutual sanctions between Europe and Russia), necessitated legislative measures aimed at mitigating the impact of rising energy prices on households. The first part of the paper aims to clarify who is a participant in the electricity and gas market and what is the current legislation in consumer protection. The second part will focus on the energy crisis as such, the impact on market participants and the state's solution to protect consumers. Here, I will focus in particular on the analysis of the instruments approved by the government in 2022 and 2023 in the form of the economic tariff, the blanket energy prices ceiling for households and the regulation of spot price contracting. In this context, I will try to assess how the above legislative changes have been translated into practice and what impact they have ultimately had on electricity and gas market participants.
