Abstract:

Komplementarita a Mezinárodní trestní soud" Táto diplomová práca sa zaoberá predovšetkým úpravou Medzinárodného trestného súdu a základným princípom na ktorom je Medzinárodný trestný súd založený, princípom komplementarity. Snahou diplomovej práce je priblížiť čitateľovi Medzinárodný trestný súd, jeho historický vývoj, jurisdikciu, a predovšetkým objasniť, čo to vlastne princíp komplementarity znamená a prečo je považovaný za jeden zo základných princípov fungovania a samotnej existencie Medzinárodného trestného súdu. Prvá časť diplomovej práce pojednáva o postupnom vzniku Medzinárodného trestného súdu, vrátane jeho historického vývoja. V stručnosti porovnáva Medzinárodný trestný súd, ako stálu medzinárodnú trestnoprávnu inštitúciu, založenú na princípe komplementarity, s ostatnými medzinárodnými tribunálmi, založenými ad hoc, fungujúcimi na princípe priority svojich právomocí pred jurisdikciami národných trestných súdov. Následne sa diplomová práca zaoberá jurisdikciou Medzinárodného trestného súdu, a to z hľadiska jurisdikcie miestnej, časovej, personálnej a vecnej, ktorá limituje univerzálnu formálnu jurisdikciu Medzinárodného trestného súdu na najzávažnejšie zločiny hrubo a zreteľne porušujúce univerzálne hodnoty, na zločin genocídy, zločiny proti ľudskosti, vojenské zločiny a zločin agresie. Podstatná časť diplomovej práce je venovaná princípu komplementarity. V podkapitolách diplomová práca objasňuje, čo to princíp komplementarity znamená, jeho význam a odlíšenie od pojmu jurisdikcie. Podrobnejšie rozoberá článok 17 Rímskeho štatútu, ktorého obsahom je zmienený princíp komplementarity a samotné kritéria prípustnosti. V záverečnej časti tejto kapitoly uvádza princíp komplementarity v súvislosti so zásadou ne bis in idem. V závere diplomovej práce je popísaný vzťah Českej republiky a Medzinárodného trestného súdu, predovšetkým právne hľadiská dlhodobého odmietania ratifikácie Rímskeho štatútu Českou republikou, vyvrátenie týchto obáv, neskoršie námietky prezidenta republiky Václava Klausa a konečné podpísanie Rímskeho štatútu, ktorým došlo k ukončeniu dlhodobého ratifikačného procesu, na konci ktorého sa Česká republika stala jednou zo zmluvných krajín Rímskeho štatútu. V poslednej kapitole sú v stručnosti uvedené námietky krajín, ktoré sú v opozícii proti Medzinárodnému trestnému súdu

Abstract:

The International Criminal Court and the Principle of Complementarity" The diploma thesis is foremost dealing with The International Criminal Court and the basic principle The International Criminal Court is based on, the principle of complementarity. The aim of the diploma thesis is to bring The International Criminal Court, its historical development and its jurisdiction closer to the reader and to clear up what exactly does the complementarity mean and why is the complementarity principle regarded as the most important principle the International Criminal Court is based on. The first part of the thesis deals with the gradual evolution of The International Criminal Court, coupled with its historical development. It briefly compares the International Criminal Court as the permanent international institution based on the principle of complementarity, with other ad hoc international tribunals, based on the primacy principle, where they have an exclusive jurisdiction and they can overrule domestic courts. In the next chapter, the thesis is concerned with the jurisdiction of The International Criminal Court, particularly the ratione loci, temporis, personae and materiae, where the last one mentioned encompasses the most serious crimes obviously violating universal values, the crime of genocide, crimes against humanity, war crimes and the crime of aggression. The substantial part of the thesis is devoted to the complementarity principle. The diploma thesis clears up what exactly the complementarity principle means, its significance, and it distinguishes the principle of complementarity from the conception of jurisdiction. The thesis enlarges the Article 17 of The Roma Statute and criteria of admission which are included in the abovementioned Article. At the end of the chapter the thesis deals with the ne bis in idem principle. Chapters placed at the end of the thesis describes the relationship between The Czech Republic and The International Criminal Court, in particular, why it took so long - from the legal point of view - to sign The Roma Statute and to end the ratification process, so The Czech Republic could become one of the member states of The Roma Statute. At the very end of the thesis, there are described some objections of few states which are in the opposition with The International Criminal Court
