Apartment Lease Termination

Abstract:

Bakalářská práce Zánik nájmu bytu se věnuje problematice nájemního bydlení se zaměřením na zánik nájmu bytu. Zánik nájmu bytu je jedním z institutů neustále se vyvíjejícího bytového práva. Cílem bakalářské práce je zhodnocení současné právní úpravy zániku nájmu bytu, a to především z pohledu zrovnoprávnění postavení pronajímatele a nájemce. První kapitola se dotýká zániku nájmu obecně, a to jednak zániku nájmu bytu absolutního, jednak relativního. Následuje pojednání o zániku nájmu bytu dohodou a uplynutím doby nájmu, které v právní praxi nepřinášejí zásadní problémy. Nejobsáhlejší část je věnována výpovědi z nájmu bytu ze strany pronajímatele. Bakalářská práce podrobněji rozebírá výpovědi z nájmu bytu s přivolením soudu a bez přivolení soudu. Práce zde přináší zejména aktuální poznatky z novelizovaného institutu zániku nájmu bytu výpovědí bez přivolení soudu, a to právě proto, že se jedná o podstatnou změnu v právní úpravě nájemního bydlení. V závěru autor práce uvádí právní následky zániku nájmu bytu se specifikací zajištění odpovídající bytové náhrady.

Abstract:

Bachelor's thesis Apartment Lease Termination is focused on the tenancy of flats and especially on apartment lease termination. The apartment lease termination is one of the institutes of the continually developing housing law. The objective of bachelor's thesis is evaluation current legal form of the apartment lease termination, namely from the view of equalization of landlord and tenant. There is noticed the apartment lease termination in general view in the first chapter. The apartment lease termination is divided into two categories – absolute and relative. The discourse about apartment lease termination by agreement and by expiration of term is next. These terminations do not bring problems in legal practice. The major attention in this bachelor's thesis is paid to apartment lease termination given by landlord. The bachelor's thesis closely deals with apartment lease termination with assent of the court and without assent of the court. The bachelor's thesis brings here namely actual knowledge in amended institute of apartment lease termination by eviction without assent of the court. This is a material alteration in legal regulations of lease. Author noticed legal consequences of apartment lease termination and especially ensuring appropriate housing compensation in the end of thesis.
