Participatory rights of the child in its representation of the body of social and legal protection of children

Abstract:

Diplomová práce je rozdělena do teoretické části a výzkumné části. Výzkumná část se sestává z kvalitativního výzkumu. Diplomová práce se věnuje realizaci participačních práv dítěte. Obsahem diplomové práce v její teoretické části je především analýza procesu realizace participačních práv dětí, při provázení dítěte procesem soudního řízení od počátku až do ukončení soudního řízení. Teoretická část je rozdělena do pěti kapitol. První kapitola se věnuje nejlepšímu zájmu dítěte, jeho potřebám a právům. V druhé kapitole je věnován prostor participačním právům. Ve třetí kapitole jsou vyjmenováni aktéři realizace participačních práv a jejich role v procesu. Čtvrtá kapitola se krátce zmiňuje o roli a oprávnění orgánu sociálně-právní ochrany dětí. Kapitola pátá je věnována realizaci participačních práv dětí od zahájení až po ukončení intervence v rodině. Výzkumná část je obsažena v následujících kapitolách. Pro výzkum je zvolen kvalitativní výzkum. Cílem diplomové práce je zhodnocení přínosu aktivní realizace participačních práv pro sociální pracovníky orgánu sociálně-právní ochrany dětí, a zajištění, jak z pohledu sociálního pracovníka na realizaci participace pohlížejí rodiče a samotné děti. Jako techniku sběru dat jsem zvolila polostrukturovaný rozhovor s respondentkami.

Abstract:

The diploma thesis is divided into a theoretical part and a research part. The research part consists of qualitative research. The diploma thesis deals with the implementation of the participatory rights of the child. The content of the diploma thesis in its theoretical part is primarily an analysis of the process of implementation of children's participation rights, in accompanying the child through the process of court proceedings from the beginning to the end of court proceedings. The theoretical part is divided into five chapters. The first chapter deals with the best interests of the child, his needs and rights. In the second chapter, space is devoted to participatory rights. The third chapter lists the actors in the implementation of participatory rights and their role in the process. The fourth chapter briefly mentions the role and authority of the social and legal protection body for children. Chapter five is devoted to the implementation of children's participation rights from the beginning to the end of the intervention in the family. The research part is contained in the following chapters. Qualitative research is chosen for the research. The aim of the diploma thesis is to evaluate the benefits of active implementation of participation rights for social workers of the body of social and legal protection of children, and to ensure how parents and children themselves view the implementation of participation from the perspective of a social worker. As a data collection technique, I chose a semi-structured interview with the respondents.
