Data Rights

Abstract:

V diplomové práci na téma "Práva k datům" se budu věnovat problematice komplexní ochrany práv k různým typům nespecifických dat. V obecné části práce popíšu pojem dat (údajů) a provedu přehled základních právních institutů používaných k jejich ochraně. Zaměřím se přitom na nespecifická data, tj. údaje, které nejsou předmětem ochrany žádným specifickým právním institutem (typicky ochranou osobních údajů, právem duševního vlastnictví apod.) Součástí výkladu bude diskuse vybraných pozičních dokumentů a legislativních návrhů týkajících se práv k nespecifickým datům a jejich ochraně především ve vztahu k právům spotřebitele. Ve zvláštní části práce se zaměřím na právní ochranu dat generovaných zařízeními a informačními systémy užívanými v rámci tzv. chytrých domácností. Na základě pragmatické analýzy populárních řešení chytrých domácností identifikuji relevantní kategorie dat a provedu právní analýzu s nimi souvisejících práv dle aktuální a perspektivní legislativy. Vedle postavení spotřebitele (obvykle v roli vlastníka příslušného zařízení) se výklad ve zvláštní části zaměří na právní postavení poskytovatele služby informační společnosti a na meze smluvní úpravy, která má nejčastěji formu různých inominátních smluv.

Abstract:

In my master thesis on the topic "Data Rights" I will deal with the issue of complex protection of rights to various types of non-specific data. In the general part of the thesis, I will describe the concept of data and review the basic legal institutes used to protect it. I will focus on non-specific data, i.e. data that are not subject to protection by any specific legal institute (typically personal data protection, intellectual property rights, etc.) The interpretation will include a discussion of selected position papers and legislative proposals concerning rights to non-specific data and their protection, especially in relation to consumer rights. In a separate part of the thesis, I will focus on the legal protection of data generated by devices and information systems used in the framework of so-called smart homes. Based on a pragmatic analysis of popular smart home solutions, I will identify relevant categories of data and conduct a legal analysis of the rights associated with them under current and prospective legislation. In addition to the position of the consumer (usually in the role of the owner of the relevant device), the interpretation in a separate section will focus on the legal position of the information service provider and the limits of contractual regulation, which most often takes the form of various innominate contracts.
