Legal Aspects and Possibilities of Establishing of the "Metropolitan Police"

Abstract:

Tématem této práce je problematika vzniku metropolitní policie. Vznik metropolitní policie je projektem Ministerstva vnitra ČR a v případě jeho realizace by došlo k podstatné změně v systému policejní správy ČR. Cílem tohoto projektu je ve městech s počtem obyvatel nad 100.000 sloučení služby pořádkové a dopravní policie působící v rámci Policie ČR s městskými policiemi do jedné složky - metropolitní policie a její vyčlenění z přímé podřízenosti Ministerstva vnitra ČR a začlenění pod samosprávu těchto měst obdobně, jako jsou doposud městská policie, ovšem s možností kontroly a případném podílu na řízení této složky ze strany Ministerstva vnitra ČR. Důsledkem sloučení by pak mělo být snížení početního stavu příslušníků Policie ČR a tím i úspora nejen mzdových prostředků pro Ministerstvo vnitra a na druhé straně pak posílení pravomocí komunálního bezpečnostního sboru podřízeného místním samosprávám, tedy zastupitelstvům dotčených měst, byť s určitými omezeními a také povinnostmi navíc oproti současnému stavu. Tato práce se tedy věnuje historií vývoje Policejní správy v ČR od r. 1990 do současnosti, srovnání současné systemizace policejní správy se zamýšlenou systemizací po případném vzniku metropolitní policie. Práce také uvádí důvody, které současné vedení Ministerstva vnitra ČR vedou k prosazování vzniku metropolitní policie, je v ní předestřen záměr Ministerstva vnitra ČR ohledně organizace a financování metropolitní policie, její vztah k Policii ČR a městské policii a jsou v ní rozebrány ty nejzásadnější problémy související s případnou realizací projektu, včetně personální otázky, otázky služebního poměru vs. pracovního poměru a otázky podřízenosti nově vzniklé metropolitní policie. Práce nepomíjí ani vyjádření představitelů místních samospráv dotčených měst a věnuje se i potřebám legislativních změn v případě vzniku metropolitní policie.

Abstract:

The topic of this work is the dilemma of the creation of the metropolitan police. The creation of the metropolitan police is the project of the Interior Ministry of the Czech Republic and its realization would mean a substantial change in the system of the police administration. The aim of this project is the consolidation of the order service and the traffic police functioning in the framework of the Police of the Czech Republic in the towns with the number of population above 100.000 into one element – the metropolitan police and its split-off from the direct subordination of the Interior Ministry of the Czech Republic and the incorporation under the autonomy of these towns likewise the municipal police but with the possibility of the check-up and the opportune rate of the controlling of the element by the Interior Ministry of the Czech Republic. The result of the consolidation should be decreasing the number of members of the Police of the Czech Republic and thereby saving not only the wage funds for the Interior Ministry of the Czech Republic and on the other side the reinforcement of the authority of the municipal police subordinating to the local autonomies, it means the councils of the respective towns although with certain restrictions and also more duties comparing with the state nowadays. This work is following the history of the development of the Police Administration of the Czech Republic since 1990 up to the present, comparing contemporary systematization of the police administration with the planned systematization after the possible creation of the metropolitan police. The work is also introducing reasons why the contemporary leadership of the Interior Ministry of the Czech Republic is promoting the creation of the metropolitan police, there is shown the intention of the Interior Ministry of the Czech Republic how to organize and finance the metropolitan police, its relationship with the Police of the Czech Republic and the municipal police and there are analyzed the most important problems connected with the possible realization of the project including the personal questions, the questions of service vs. employment and the questions of the subordination of the newly created metropolitan police. The work is also mentioning the opinions of the councils of the respective towns and following the needs of the legislative changes in the case of the creation of the metropolitan police.
