Supervision of Public Prosecutor in Preliminary Criminal Proceedings

Abstract:

V bakalářské práci je vymezeno postavení státního zástupce v přípravném řízení trestním s vyústěním do jeho dozorových činností uvedených v § 174 tr. řádu. V úvodu se věnuji vývoji veřejné žaloby, jejímu konstituování a postavení v ČR a také vymezuji institut Evropské-ho veřejného žalobce. Část práce je věnována přípravnému řízení trestnímu, kde jsou charakterizovány role policejního orgánu a státního zastupitelství. Závěrem se věnuji úvahám de lege ferenda dozoru státního zástupce, kde jsou mimo teoretických znalostí zohledněny i zkušenosti státních zástupců a příslušníku PČR.

Abstract:

In this bachelor thesis, the position of the public prosecutor in the pretrial criminal proceedings is defined resulting in his supervisory activities listed in Section 174 of the Code of Criminal Procedure. In the introduction, I deal with the development of the public prosecution, its constitution and position in the Czech Republic and I also define the institution of the European Public Prosecutor. Part of this thesis is devoted to the pre-trial criminal proceedings, where the roles of the police body and the public prosecutor's office are characterized. Finally, I am engaged in reflection de lege ferenda on the prosecutor's supervision, where, apart from the theoretical knowledge, the experience of public prosecutors and members of the Police of the Czech Republic is also taken into account.
