Abstract:

Tato práce pojednává o trestním právu mladistvých, které se od 1. 1. 2004, kdy se stal účinným zákon č. 218/2003 Sb., těší samostatné právní úpravě. Zákon č. 218/2003 Sb., o odpovědnosti mládeže za protiprávní činy a o soudnictví ve věcech mládeže a o změně některých zákonů (o soudnictví ve věcech mládeže), je lex specialis k zákonu č. 140/1961 Sb., trestnímu zákon, a zákonu č. 141/1961 Sb., o trestním řízení soudním neboli trestnímu řádu. Zákon historicky navazuje na myšlenky a instituty zákona č. 48/1931 Sb. a n., o trestním soudnictví nad mládeží. Zákon o soudnictví ve věcech mládeže je vystavěn na zvláštních zásadách a odlišné terminologii než obecné trestněprávní předpisy. Jeho účelem je zejména vychovat pachatele a předejít jeho další trestné činnosti. Zákon umožňuje uložit tři druhy opatření, které jsou obdobou trestů v trestním právu dospělých: výchovná opatření, ochranná opatření a trestní opatření. Trestní opatření, a zejména trestní opatření odnětí svobody nepodmíněně, se má ukládat pouze, nelze-li účelu zákona dosáhnout jinak. Zákon navíc přináší značné množství hmotněprávních i procesněprávních institutů, které umožňují vyřešit proviněné jiných způsobem než uložením opatření. Mezi ně patří například upuštění od uložení trestního opatření v hmotněprávní rovině nebo odklony (včetně speciálního odstoupení od trestního stíhání) v rovině procesněprávní. Zákon přinesl také změnu místní příslušnosti u mladistvých, která se řídí místem, kde mladistvý bydlí, a oficiálně bylo do zákona vneseno ustanovení o zvláštních senátech a samosoudcích, tzv. soudech mládeže, které působí uvnitř obecných soudů. K novému zákonu již vznikl také dostatek judikatury, která je též součástí této práce. Zákon je celkově dobře konstruován, má sice některé drobné nedostatky, ale ty se praxí řeší.

Abstract:

The diploma thesis covers the problem of youth deliquency and youth criminal law. The most recent Czech act on juvenile criminal law is Act No. 218/2003 Coll., on Liability of Juveniles for Illegal Acts and on Juvenile Justice and Amending Certain Acts (the Act on Juvenile Justice), which came into force on 1 January 2004. This act was a huge progress in legislation as there had been no self-contained law concerning youth criminal justice since 1950. Act No. 218/2003 Coll. was inspired both by foreign legislation and former Czech act of 1931. The Act on Juvenile Justice is closely related to Act No. 140/1961 Coll., the Criminal Code and Act No. 141/1961 Coll., the Code of Criminal Procedure because the Act on Juvenile Justice functions as lex specialis to both the Codes. Act No. 218/2003 Coll. is mainly used for youth criminals aged 15 to 17 included. Whenever the Act of 2003 lacks general provisions, both the Criminal Code of 1961 and the Code of Criminal Procedure are used to fill in the gaps. The aim of Act No. 218/2003 Coll. is to create appropriate conditions for the correction of deliquent juveniles. Its purpose is not to punish the youth primarily, but to change their behavior and prevent them from committing repeated offences. The Act aims to ensure that youth deliquents refrain from comitting other illegal acts, and find their place in the society, corresponding to their abilities. The Act on Juvenile Justice brought many important changes into juvenile criminal law. One of them was introducing a new system and hierarchy of measures, which can be imposed on the juveniles. One of the best things introduced in the Act were educational measures. The aim of the Act is to use educational measures rather than criminal measures because criminal measures, particularly probation without conditional suspension, can affect the youth. Apart from educational measures and criminal measures, it is also possible to impose protective measures on the deliquent. The Act supports the use of diversions, which make it possible for the deliquent to avoid court proceedings. Diversions may be used in the pre-trial proceedings or the proceedings before the court. The act is based on the cooperation of the police, courts, prosecutors, family, school, the Probation and Mediation Service and official bodies. It demands professional training of the officials which deal with the youth deliquents. The Act also officially introduced specialized juvenile courts. Although there have been several difficulties with the application of the Act, most of them were solved due to case law or other measures.
