Abstract:

Ve své diplomové práci se zabývám problematikou regulace ve zprostředkování pojistných a pojistně-finančních produktů v souvislosti s návrhem nového sektorového zákona o distribuci pojištění a zajištění a nahrazení stávajícího zákona číslo 38/2004 Sb., o pojišťovacích zprostředkovatelích a samostatných likvidátorech. Obsah práce je zaměřen na: A) Historické souvislosti vedoucí k revizi stávajícího regulatorního rámce upravujícího zprostředkování pojistných produktů. B) Důvody vedoucí k návrhu regulatorních změn. C) Způsoby řešení ve znění jednotlivých ustanovení návrhu zákona o distribuci pojištění a zajištění. D) Zhodnocení a komentář k řešení klíčových cílů regulace prostřednictvím jednotlivých ustanovení zákona. Hlavním cílem práce je přiblížit čtenáři, v ucelené a srozumitelné formě, problematiku regulace v distribuci pojištění, prostřednictvím komentované analýzy a zhodnocení pravděpodobného přínosu navrhovaného zákona, s predikcí dopadů do praxe distributorů pojistných služeb a produktů a celkového efektu na obor distribuce v sektoru pojišťovnictví.

Abstract:

In my thesis I deal with the issue of regulation in mediation of insurance and insurance-financial products in connection with the proposal of a new sectoral law on distribution of insurance and reinsurance, and replacement of the existing Act No. 38/2004 Coll., On Insurance Intermediaries and Independent Liquidators. The content of the thesis is focused on: A) Historical context leading to the revision of the existing regulatory framework of the mediation insurance products. B) Reasons for drafting changes in regulation. C) Methods of solution in the wording of the particular provisions of the law draft on the distribution of insurance and reinsurance. D) Evaluation and comment on the solution of key regulatory objectives. The main objective of the thesis is to bring the reader in a comprehensive and understandable way of the issue using commentary analysis and evaluation of the likely contribution of the proposed law, and predict the impacts on the practice of the insurance distributors and expected general effect on the branch.
