Implementation of the PSD 2 directive in the Czech Republic and its use by FinTech companies

Abstract:

Tato diplomová práce pojednává o současné podobě platebního styku a platebních služebv kontextu se směrnicí Evropského parlamentu a Rady 2015/2366/ES, známé pod názvemPSD 2. Práce se zabývá všeobecnou definicí platebního styku, s akcentem na aktuálnípodobu platebních nástrojů a subjektů působících v této oblasti. V práci je dále vymezenvývoj právní úpravy platebního styku s detailnějším zaměřením na aktuální změny, kterévešly v platnost v souvislosti s nabytím účinnosti směrnice PSD 2. Nabytí účinnosti danésměrnice dává prostor pro vznik novým subjektům na trhu platebních služeb, kterésloučením finanční a technologické oblasti mohou nově vytvářet inovativní platebnírozhraní, služby a produkty. Vznik nových subjektů může ohrozit dosavadní monopolnípostavení bank a dalších poskytovatelů platebních služeb působících v této oblasti, čemužse věnuje závěrečná část této práce.

Abstract:

This master´s thesis deals with recent view on payment system and payment services thatwere implemented in the Directive of the European Parliament and of the Council2015/2366/ES, which is known as PSD 2. The thesis concentrates on the common defitionof payment system particularly, on the recent payment instruments and companies whooperate in this field of business. Furthermore the thesis points out current progress of legalregulation withing the PSD 2 scope. PSD 2 has created new opportunities for companiesthat are active in the financial and technogical field. This creates new inovative ways ofpayment procedure, as well as new services and products. The creation of new companiesmay as well be considered as one of the risks for current banks and payment servicesproviders which is described at the end of this thesis in a more specific way.
