Prohibition to Undertake Activities from the Point fo View of Criminal Law and Administrative Law

Abstract:

Diplomová práce se zabývá zákazem činnosti z pohledu trestního práva a správního práva. Jejím cílem je analýza trestu zákazu činnosti, ukládaného podle trestního zákoníku a sankce zákazu činnosti, ukládané podle přestupkového zákona a také jejich vzájemné srovnání. Východiskem pro zpracování tématu je seznámení se základními zásadami trestání a sankčním systémem v České republice. Další kapitoly se věnují vlastní analýze trestu zákazu činnosti podle trestního práva a sankci zákazu činnosti podle správního práva, a to zejména historii zákazu činnosti v právních předpisech, dále podmínkám ukládání trestu a sankce zákazu činnosti, jejich výměrám, druhům, rozsahu a okruhům zakázaných činností a také výkonu trestu a sankce zákazu činnosti. Závěrem je provedeno jejich vzájemné srovnání, zhodnocena platná právní úprava a nastíněny náměty de lege ferenda.

Abstract:

This thesis focuses on the prohibition to undertake activities from the point of view of criminal and administrative law. Its main goal is to analyze sentences and sanctions concerning the prohibition to undertake activities which are imposed according to the criminal code and also to the misdemeanours act and their reciprocal comparison. The foundation of the thesis is familiarization with the fundamental principles of sentencing and imposing sanctions in the Czech Republic. The thesis is also focused on analysis of sentences according to the criminal code, and sanctions according to the administrative law. The emphasis is put particularly on the history of prohibition to undertake activities as outlined in legal enactments. Other chapters then address conditions for imposing sentences and sanctions, the range, scope, and types of prohibited activities, and also sentence execution and sanctions. All these aspects are compared at the end of the thesis together with an evaluation of current enactments and expression de lege ferenda.
