Tax Offenses and Crimes

Abstract:

Bakalářská práce na téma „Daňové delikty a trestné činy“ ve stěžejních bodech mapuje principy a systém regulace odpovědnosti za porušení norem stanovených daňovými, resp. finančními předpisy, které mohou vyústit až ke vzniku odpovědnosti trestní. Reaguje na lidská jednání porušující povinnosti vyplývající z daňověprávních vztahů, ať již vyžadují či nevyžadují zavinění. Zabývá se předpoklady a následky daňových deliktů v rovině finančně právní a trestně právní. V tomto směru přibližuje základní pojmy, zmiňuje právní úpravu a v největší míře se zaměřuje na konkretizaci deliktů samotných a sankcí, které je možné za tyto delikty uložit.

Abstract:

The bachelor work called „Tax Offences and Crimes“ within its basic points maps the principles and the regulation system of responsibility for infringement of standards stipulated by the tax or finance regulations, which may end up even in a penal responsibility inception. It responds the human activity, which infringes the duties in connection with tax-legal relations, whether it require the fact of guiltiness, or not. It deals with tax misconducts presumptions and consequences at the level of finance-legal and of the penal-legal as well. In terms of this fact, it makes clear the basic conceptions, comes up with legal modification and in greatest extent it details the misconducts themselves and corresponding sanctions, which are possible to be applied.
