Restorative justice in the criminal law environment

Abstract:

Disertační práce se zabývá otázkami restorativní justice v českém trestním právu. Samotná práce je kromě úvodu a závěru rozdělena na obecnou a zvláštní část. Obecná část se zabývá teoretickým konceptem restorativní justice. Úvodní kapitoly se zabývají definicí restorativní justice a jejich principy a koncept restorativní justice je pak zasazen do historických souvislostí. Opomenuta nezůstává ani problematika restorativní justice ve vztahu k retributivní justici. Poté se práce zabývá subjekty restorativní justice, tj. obětí, pachatelem a komunitou, což je následováno popisem konkrétních restorativních postupů a programů, jako jsou mediace mezi obětí a pachatelem, rodinné skupinové konference a kruhy. Následující kapitola se zabývá vztahem restorativní justice a alternativních trestů. Obecná část je uzavřena stručným přehledem vybraných zahraničních právních úprav na sledovaném úseku. Zvláštní část se zabývá projevy restorativní justice v českém právním prostředí a jejími odrazy v normách českého trestního práva. Nejdříve v logické návaznosti na obecnou část definuje procesní pojmy poškozeného a obviněného. Další kapitola se zabývá otázkami mediace mezi obětí a pachatelem realizované prostřednictvím Probační a mediační služby. Poté přináší přehled nejtypičtějších odrazů restorativní justice v normách českého trestního práva, tj. procesních odklonů. Opomenutými nezůstávají ani méně tradiční pohledy na restorativní justici v českém právním prostředí. Závěr práce se zabývá restorativními principy v souvislosti se zákonem o soudnictví ve věcech mládeže.

Abstract:

This dissertation deals with the issues of restorative justice in the Czech criminal law. In addition to the introduction and conclusion the paper itself is divided into a general and a special part. The general part deals with the theoretical concept of restorative justice. Introductory chapters deal with the definition of restorative justice and its principles and the concept of restorative justice is then set in a historical context. The issue of restorative justice in relation to retributive justice is not being left out. Further the paper deals with the subjects of restorative justice, i.e. victims, offenders and the communities, which is followed by a description of specific restorative procedures and programs, such as victim offender mediation, family group conferencing and circles. The next chapter deals with the relationship of restorative justice and alternative sentencing. The general part is concluded by a brief overview of international legislation of selected countries in the pursued area. The special section deals with the manifestations of restorative justice in the Czech legal environment and its reflections in the statutes of Czech criminal law. In the beginning logically following-up the general section the prosecution terms aggrieved and accused are defined. The next chapter deals with the issues of victim offender mediation made through the Probation and Mediation Services. The special section then provides an overview of the most typical reflections of restorative justice in the statutes of Czech criminal law, i.e. the diversions. Less traditional views on restorative justice in the Czech legal environment are not being left out either. The last part of the dissertation deals with restorative principles in connection with juvenile justice law.
