Probation and mediation service in connection with the execution of alternative sentences.

Abstract:

Předložená diplomová práce pojednává o Probační a mediační službě ČR v souvislosti s výkonem alternativních trestů. Probační a mediační služba ČR byla zřízena v přímé souvislosti s celkovou systémovou změnou trestního práva, trestní politiky a trestní justice. Ve své práci se věnuji rozsáhle, činnostem probačních úředníků v souvislosti s výkonem alternativních trestů, zejména trestu výkonu domácího vězení, kterému je věnovaná praktická část. Na praktickém příkladu charakterizuji odsouzené k výkonu trestu domácího vězení, se kterými vedu telefonický rozhovor za účelem zjištění jejich osobního pohledu na výkon trestu. V závěru mé práce uvádím i stručný osobní pohled probačních úřadníků na danou problematiku, kteří se potýkají s řadou problémů, a znesnadňují si tím svou každodenní práci. Jedním z nich je nedostatek elektronického monitorovacího systému a aktuálně i vládní nařízení spojené s omezením, které vyhlašuje pro území České republiky z důvodu ohrožení zdraví v souvislosti s prokázáním výskytu koronaviru nouzový stav na dobu od 14.00 hodin dne 12. března 2020 minimálně do 17. května 2020.

Abstract:

This diploma thesis deals with the Probation and Mediation Service of the Czech Republic in connection with the execution of alternative sentences. The Probation and Mediation Service of the Czech Republic was established in direct connection with the overall systemic change of criminal law, criminal policy and criminal justice. In my work I deal extensively with the activities of probation officers in connection with the execution of alternative punishments, especially the punishment of execution of house arrest, which is devoted to the practical part of my work. On a practical example, I characterize convicts for the execution of a house arrest sentence, with whom I conduct a telephone interview in order to determine their personal perspective on the execution of the sentence. At the end of my work I also present a personal view of probation officers on the issue, who are facing a number of problems that make their daily work more difficult for them. One of them is the lack of an electronic monitoring system and, at the same time, a governmental regulation related to the restriction which declares an emergency for the territory of the Czech Republic due to health threats in connection with proving the occurrence of coronavir 2020.
