Protection against Unfair Commercial Practices

Abstract:

Téma diplomové práce se zabývá ochranou proti nekalým obchodním praktikám. Práce je rozdělena do čtyř kapitol. První kapitola představuje v obecném měřítku pojem obchodní praktika, druhá kapitola zkoumá směrnici 2005/29/ES a její novelu (2019/2161), třetí kapitola představuje několik příkladů z praxe, a čtvrtá kapitola se věnuje ZVTS, směrnici 2019/613, a taktéž uvádí několik praktických příkladů. Cílem této diplomové práce je popsat a analyzovat platnou právní úpravu nekalých obchodních praktik v českém právu, a to s ohledem na směrnici 2005/29/ES, a dále novelu této směrnice (2019/2161), která ještě nebyla transponována. Jelikož se tyto způsoby jednání dotýkají nově i vztahů mezi podnikateli navzájem (B2B, business to business), porovnám také úpravu existující v ZVTS a směrnici 2019/613, která bude do tohoto zákona implementována.

Abstract:

The topic of the diploma thesis deals with protection against unfair commercial practices. The thesis is divided into four chapters. The first chapter introduces the concept of commercial practice, the second chapter examines Directive 2005/29/EC and its amendment (2019/2161), the third chapter presents several practical examples, and the fourth chapter deals with the Act on Significant Market Power, Directive 2019/613 and also gives several practical examples. The aim of this thesis is to describe and analyze the current legislation of the unfair commercial practices in Czech law, with regard to Directive 2005/29/EC and its amendment (2019/2161), which has not yet been transposed. As these ways of acting now also affect relations between enterpreneurs (B2B, business to business), I will also compare regulation existing in the Act on Significant Market Power and Directive 2019/613, which will be transposed into this Act.
