Jurisprudence of the Court of Justice of the European Union in Criminal Matters

Abstract:

Práce se zaměřuje na rozbor rozsudků Soudního dvora zejména co se týče rozhodování o předběžných otázkách, z toho jsou následně vyvozovány závěry a analýza rozhodovací praxe Soudního dvora jako taková. V úvodu jsou vysvětleny základní historické aspekty vývoje Evropské Unie a trestního práva, následně historie a vznik Soudního dvora jako organizace. Dále je vysvětlena organizace a obecná funkce Soudní-ho dvora v rámci Unie. V praktické části jsou potom rozebrány jednotlivá témata, na která se rozhodovací praxe Soudního dvora zaměřuje. Ke každému tématu je zpracováno několik rozhodnutí o předběžné otázce. Na těch jsou potom ukázané a vysvětlené principy rozhodování Soudního dvora. V závěru práce jsou tyto principy shrnuty a je zhodnocena rozhodovací praxe jako celek s přihlédnutím na kvalitativní i kvantitativní stránky, včetně úvah pro budoucí zefektivnění.

Abstract:

This thesis focuses on the analysis of the judgments of the Court of Jus-tice, especially about decisions on preliminary rulings. Conclusions and an analysis of the decision-making practice of the Court is subsequently drawn. In the introduction, the basic historical aspects of the develop-ment of the European Union and criminal law are explained, followed by the history and establishment of the Court of Justice of the EU as an organization. Furthermore, the organization and general function of the Court of Justice are explained. In the practical part of the thesis, the in-dividual topics, on which the decision-making practice of the Court of Justice is focused, are discussed. For each topic, several preliminary rulings are processed. The principles of decision-making of the Court of Justice are then shown and explained on them. At the end of the thesis, these principles are summarized and the decision-making practice as a whole is evaluated, taking qualitative and quantitative aspects into ac-count, including considerations for future efficiency.
