The possibility of introducing a nationwide referendum in Czech political environment

Abstract:

Diplomová práce se zabývá možností zavedení všeobecného referenda v politickém prostředí ČR a jejím cílem je analyzovat tyto možnosti. Diplomová práce je rozdělená do dvou částí, do části teoretické a části praktické. Teoretická část této diplomové práce přináší základní informace o demokracii jako takové, přičemž představuje základní členění tohoto pojmu, srovnává přímou demokracii s demokracii zastupitelskou, představuje jednotlivé instituty přímé demokracie a detailně je popisuje, rozebírá instituty přímé demokracie v České republice a přináší příklady praxe přímé demokracie ve vybraných evropských zemích. Cílem praktické části je analýza příčin neúspěchu jednotlivých pokusů o zavedení obecně upraveného celostátního referenda v České republice, které proběhly během devíti volebních období. Diplomová práce je určena pro širokou veřejnost, ale může současně sloužit jako zdroj pro studium, neboť bylo při jejím zpracování využito odborných zdrojů z oblasti práva, veřejné správy a politologie. Současně tato diplomová práce může být využita, jakožto podklad možné diskuse týkající se možnosti zavedení všeobecného referenda v ČR.

Abstract:

This master's thesis is concerned with the implemention of general referendum about political climate in CZ and its goal is to analyze various options of accomplishing it. The work is divided into two parts, theoretical and practical. The former offers general theoretical foundation for Democracy in and of itself, more specifically basic definition of the term, juxtaposition between direct democracy and proxy democracy, introduction of individual governing bodies (institutes) of direct democracy with detailed description thereof, and finally examination of those institutions of direct democracy in Czech Republic together with examples of its practice across select European countries. The practictal part, on the other hand, aims is to analyze probable causes of failure of previous attempts to implement general nationwide referendum in Czech Republic which were undertaken over the course of nine presidential terms in the past. While general public is the primary target group for this thesis, its implications can also provide an invaluable tool for further research because it draws on numerous scholarly sources from diverse areas of law, public administration, and politology. At the same time, this work can be used as a catalyst in initiating a discussion regarding the implementation of general referendum in CZ.
