State-owned Undertakings and their Property Structure

Abstract:

Bakalářská práce si klade za cíl seznámit čtenáře s platnou právní úpravou podniků s majetkovou účastí státu. Po jejím přečtení byste měli být seznámeni s problematikou podniků, které může stát zakládat a vlastnit nebo spoluvlastnit. V obecné části se čtenář seznámí se základními pojmy, s vnitřní strukturou podniků, způsobem rozdělení a následným daněním zisku, s majetkovou strukturou podniků, a v neposlední řadě založením a zánikem. Ve zvláštní části použiji poznatky z obecné části k analýze dvou konkrétních podniků vlastněných státem a zjistím, který z typů podniků je pro stát výhodnější a jaké jsou problémy ve spojení s vlastnictvím podniků státem.

Abstract:

The purpose of this thesis is to apprise the reader with existing legislation that regulates state-owned undertakings and their property structure. After reading one should be able to understand state-owned undertakings that the state can establish and its ownership and co-ownership. The general part will present basic facts for understanding the special part. In the general part reader will be familiarized with internal structure of undertakings, with dividing and taxation of the profit, with property stucture and last but not least its foundation and termination. The special part will use facts from the general part for analysis two particular state-owned undertakings and will find out which one is preferable for the state and indentificate the problems associated with ownership of undertakings by the state.
