Patient's right to information from medical records

Abstract:

V této bakalářské práci autorka zaměřila svou pozornost na vymezení práv pacienta na informace ze zdravotnické dokumentace týkající se jeho osoby. V úvodu je zmíněna legislativa, která tato práva upravuje a následuje definice zdravotnické dokumentace a popis jejích náležitostí. Práce obsahuje detailní rozpis všech práv pacienta v souvislosti s jeho zdravotnickou dokumentací a také seznam osob, které také mají ze zákona právo na informace ze zdravotnické dokumentace pacienta. Na závěr práce je uveden krátký popis teoreticky správného postupu, při vyžadování informací ze zdravotnické dokumentace (kopií nebo požadavek na nahlédnutí do zdravotnické dokumentace). Dále je uvedeno pro ilustraci celé problematiky několik popisných případových studií, které byly jednotlivě vyhodnoceny na základě získaných teoretických znalostí této bakalářské práce. Tato diplomová práce vychází ze stavu právního řádu ke dni 1. 3. 2012.

Abstract:

The attention of this thesis is aimed to define the rights of the patient in regards to the informations from his medical records. In the beginning the legislation that regulates these rights. Next you can find definition of what are medical records and description of their essential content. This thesis includes detailed list of all the patients's rights in regards to information from his medical records and mentions who else can use these rights as well. There is also a list of other people, who have these rights guaranteed by the law. In the closing of this thesis there is a short manual describing the theoretically right method for requesting the information from medical records (copy or request to gain access to the medical records). Then there are some illustrative case studies, which were evaluated based on the theoretical parts of this thesis. This thesis is based on actual state of Czech law on March 1st 2012.
