Summary Administrative Procedure and its Sorts

Abstract:

Obsahem práce je definovat některé druhy zkrácených správních řízení, jejich charakteristika a odchylky od klasických, tedy nezkrácených správních řízení. Práce je rozdělena do teoretické a praktické části, přičemž teoretická část je zaměřena na obecné pojmy z oblasti správního práva a druhá praktická část přímo charakterizuje zkrácená správní řízení v různých oblastech správního práva. Společným znakem zkrácených správních řízení je požadavek na co nejméně formální správní řízení, jehož základními znaky by měla být rychlost a efektivita. Zkrácená správní řízení mohou být využívána v jednodušších typech správních řízení a jen za splnění zákonem stanovených podmínek. V některých případech je možnost využít zkrácené správní řízení na uvážení správního orgánu, jindy je stanovena povinnost používat zjednodušující postupy správních řízení přímo zákonem. Práce je věnována některým druhům zkrácených správních řízení a to zejména zkráceným správním řízení podle správního řádu, podle přestupkového zákona, podle stavebního zákona, podle zákona o veřejném zdravotním pojištění a podle zákona o nemocenském pojištění

Abstract:

The content of the work is a definition of some types of the shortened administrative procedures, their characteristic and their divergence in comparison to the ordinary administrative procedures that are not shortened. The work is divided into a theoretical and a practical part, where the theoretical part focuses on the general terms in the field of administrative law while the practical part directly characterises the shortened administrative procedures concerning different fields of the administrative law. The common characteristic of the shortened administrative procedures is a demand for the administrative procedure to be the least formal possible, thus the essential features being rapidity and efficiency. The shortened administrative procedures can be used in the less complicated types of administrative procedures and only when the conditions defined by the law are fulfilled. In some cases, there is a possibility to use the shortened administrative procedure on the basis of the decision of an administrative authority, while in some cases there is an obligation to the usage of the shortened administrative procedure defined directly by the law. The work is dedicated to some types of the shortened administrative procedures, particuarly to the shortened administrative procedures based on the administrative system, the misdemeanour law, the construction law, the law on public health insurance and the law on health insurance for the gainfully employed
