Direct Election of the Mayor of the Municipality

Abstract:

V této diplomové práci je provedena analýza zavedení přímé volby starosty obcí do právního systému České republiky. Je zde uvedena obecná právní charakteristika stávající právní úpravy, která vymezuje postavení starosty obce, jeho volbu a pravomoci, včetně popisu jeho postavení vůči ostatním orgánům obce s odkazem na konkrétní právní normy. Dále je potom popsán systém volby starostů obcí ve vybraných evropských zemích a také průběh projednávání tohoto záměru v České republice. Nejvíce pozornosti je věnováno vytvoření konkrétního modelu přímé volby starostů obcí s odůvodněním jednotlivých prvků této volby. Jsou zde uvedeny i změny právního řádu České republiky, které by bylo nezbytné provést pro přijetí přímé volby. V závěrečné části je učiněn návrh, jak dále přistupovat k otázce přímé volby starostů obcí a posouzení vhodnosti jejího zavedení.

Abstract:

In this diploma work is made an analysis of the introduction of direct election of mayors into the legal system of the Czech Republic. Presented here is general legal characterization of the existing legislation, which defines the position of mayor, the election and his competencies, including a description of his position in relation to other municipal authorities with reference to specific legal standards. Furthermore then is described the system of election of mayors in selected European countries as well as the course of discussing of this intent in Czech Republic. Most attention is devoted to the creation of a specific model of direct election of mayors with the justification of individual elements of this election. They are presented here as well as changes in the legal order of the Czech Republic, which would be necessary to carry out for adoption of direct elections. In the final part is made the proposal, how to further approach the issue of direct election of mayors and assessing the suitability of its introduction.
