Extent of contractual freedom in labor law

Abstract:

Diplomová práce bude věnována problematice vymezení rozsahu smluvní volnosti v českém pracovním právu. Tato práce bude zaměřena na pracovní právo obecně, od jeho historie, až po současnost, vymezení pracovněprávních pojmů, vymezení smluvní volnosti ve smyslu „co není zakázáno, je dovoleno“ a zásady smluvní volnosti, jakožto jedné ze zásad pro soukromé právo. Práce tedy bude pojednávat nejenom o pracovním právu obecně, ale hlavně o smluvní volnosti, o tom, jakým způsobem pracovní právo chrání podřízené zaměstnance před jejich zaměstnavateli a jakým způsobem jim zajišťuje důstojné podmínky pro výkon jejich pracovních činností. Výzkumná otázka zní: "Je smluvní volnost v pracovním právu v České republice dostačující?"

Abstract:

The diploma thesis will be devoted to the issue of defining the scope of contractual freedom in Czech labor law. This work will focus on labor law in general, from its history to the present, the definition of labor law concepts, the definition of contractual freedom in the sense of "what is not forbidden is allowed" and the principles of contractual freedom, as one of the principles of private law. Thus, the thesis will deal not only with labor law in general, but mainly with contractual freedom, how labor law protects subordinate employees from their employers and what in a way provides them with decent conditions for the performance of their work activities. The research question is: "Is contractual freedom in labor law in the Czech Republic sufficient?"
