British and American English: The Comparison of Legal Terminology Across Legal Branches

Abstract:

Právní věda, stejně jako všechny ostatní vědy, má svou vlastní terminologii. Právní praxe se v posledních letech snaží opustit specifický právnický žargon a právní jazyk zjednodušit a zpřehlednit tak, aby byl srozumitelný i pro neprávníka. Přesto se ozývají hlasy, které volají po tom, aby si právo svoji terminologii ponechalo, a to především kvůli komplexitě právní vědy jako takové. O to zajímavější je srovnání a vysvětlení základních právních institutů a terminologie právnické angličtiny, která se používá především ve Spojeném království a Spojených státech amerických. Tato práce si klade za cíl odhalit rozdíly v právním jazyce těchto dvou zemí a jejich příčiny. Cílem je odpovědět na otázku, zda lze rozdíly považovat za markantní a mohou vést k vážným nedorozuměním. Práce také pojednává o zjednodušování právnického jazyka v posledních letech a zkoumá, zda právnické angličtině rozumí i laik. Práce je rozdělena na úvod, teoretickou část, praktickou část a závěr. Teoretická část obsahuje dvě velké podkapitoly. První seznamuje s právním jazykem, jeho významem a vývojem, zatímco druhý představuje systém common law, jednotlivá právní odvětví a historické kořeny tohoto systému. Praktická část je zaměřena na různorodou terminologii rozdělenou do jednotlivých oblastí. V této části jsou diskutovány hlavní rozdíly. Závěr obsahuje odpověď na výzkumnou otázku na základě faktů a myšlenek uvedených v práci.

Abstract:

Legal science, just like any other science, has its own terminology. In recent years, the legal practice has striven to abandon legalese and tried to simplify and clarify the legal language for it to be understandable even for a non-lawyer. Yet, there are some voices on why to keep legalese as it is due to the complexity of legal studies. All the more interesting is comparing and explaining basic legal institutes and terminology of legalese, which is used mainly in the United Kingdom and the United States. The proposed paper seeks to reveal differences in the legal language of these two countries and the causes of the differences. The aim of the proposed paper is to answer the question if the disparities could be viewed as striking and whether serious misunderstanding can occur. The thesis also discusses the simplification of legalese in recent years and examines if a layman understands it. The thesis is divided into an introduction, theoretical, practical part and conclusion. The theoretical part includes two sections. The first one introduces the legal language, its meaning and the development of English, whereas the latter presents the common law system, legal branches and its historical roots of law. The practical part is centred around the diverse terminology divided by particular areas. In this part, the major differences are discussed. The conclusion includes the answer to the research question based on the facts and thoughts presented in the thesis.
