Authorized Inspector in the Conditions of the Building Act.

Abstract:

Autorizovaný inspektor je od počátku roku 2007 zcela novým pojmem v českém veřejném stavebním právu. Stavební zákon č. 183/2006 Sb., institut autorizovaného inspektora zavádí jako alternativu ke stavebnímu úřadu ve stavebním řízení. Autorizovaný inspektor v rámci zkráceného stavebního řízení vydává certifikát, kterým osvědčuje, že navrhovaná stavba je proveditelná tak, jak je navržena. Tento certifikát nahrazuje stavební povolení a stavebníkovi po oznámení certifikátu na stavebním úřadě vznikne právo stavbu uskutečnit. Tématem práce je autorizovaný inspektor, postup při vydávání certifikátu, pojednává o problémech, které se projevily v praxi v souvislosti s vydáváním certifikátů a jejich možných řešeních.

Abstract:

Authorized inspector has been a completely new concept in the Czech public construction law since the beginning of 2007. Building Act No. 183/2006 Coll. introduced the institute of authorized inspector as an alternative to the construction administration in the building management. The authorized inspector issues a certificate under an accelerated construction management to certify that the proposed construction is feasible as it is designed. This certificate replaces the building permit and the builder, after declaring the certificate at the office of the construction administration, will be entitled to carry out the construction. The topic of the thesis is the authorized inspector, the procedure of issuing the certificate; it discusses the problems that resulted in practice in connection with issuing the certificates and their possible solutions.
