Interpretation of Uncertain Concepts in Administrative Law

Abstract:

Navrhovaná práce s názvem Interpretace neurčitých pojmů ve správním právu představuje jeden z možných přístupů k interpretaci v právu v obecné míře. Na příkladu neurčitých právních pojmů a za užití některých teoretických prvků francouzské interpretativní sémantiky a české strukturalistické lingvistiky navrhuje sjednocení právních výkladových metod. Neurčité pojmy jsou v práci definovány jako pojmy s nejednoznačně definovaným a definovatelným rozsahem, který se tak vymezuje oproti interpretovatelnému obsahu. Nedefinovatelný rozsah je tak zároveň kategorickou podmínkou pro vytvoření paradigmatu neurčitého pojmu. Na příkladech je ukázáno, že, ač rozsahem nedefinovatelné, lze neurčité pojmy na základě jejich jistých imanentních vlastností i rozumně kategorizovat, což se rekurzivně vrací i ke způsobu jejich výkladu.

Abstract:

The present thesis Interpretation of Uncertain Concepts in Administrative Law offers one of the possible universal approaches to the interpretation in law. The thesis proposes a unification of all legal interpretation methods by example of Uncertain Legal Concepts and using some theoretical elements of the French Interpretative Semantics and Czech Structural Linguistics. In the thesis, the uncertain concepts are defined as legal terms with an ambiguously determined and determinable extension which opposes to the interpretable intension. Undefinable extension is the critical condition for the categorical paradigm of the uncertain concepts. The examples illustrate the possibility of the categorization of the uncertain concepts on the basis of their certain immanent properties. The categorization can be used during the interpretation.
