Abstract:

Výslech v přípravném trestním řízení je jedním z důležitých procesních úkonů trestního práva. Získávání relevantních informací během výslechu podléhá přísnému dodržování právních předpisů za současného použití taktických kriminalistických postupů a poznatků z forenzní psychologie. Cílem diplomové práce bylo zjistit, zda lze bezproblémově provést výslech při současném zachování práv vyslýchaných osob. Diplomová práce v počáteční části definuje přípravné trestní řízení a výslech. V dalších částech se věnuje provedení výslechu, kde jsou zahrnuty kriminalistické metody a poznatky z forenzní psychologie. Závěrečná část obsahuje druhy výslechů dle procesního postavení, trestní minulosti a dle fyzických a psychických dispozic vyslýchaných osob. Hlavní pozornost je věnována právům a povinnostem vyslýchané osoby dle současné právní úpravy.

Abstract:

Pre-trial interrogation is one of the most important procedural acts of Criminal Law during criminal proceedings. Obtaining any relevant information during interrogation, while using tactical forensic procedures and knowledge of forensic psychology, is subject to strict legal compliance. The aim of this thesis is to find out whether the pre-trial interrogation can be carried out without any issues while at the same time preserving the rights of the interrogated persons. First section of this thesis defines the preparatory criminal proceedings and interrogation. Second section is devoted to the interrogation itself, including forensic methods and knowledge of forensic psychology. Third and final section describes the types of interrogations according to the procedural status, criminal history and according to the physical and mental dispositions of the interrogated persons. The main attention is paid to the rights and obligations of the interrogated person under the current legislation.
