Sections of the Armed Forces of the Czech Republic and their position in the system of administrative law institutions in the Czech Republic (Social mission of the Czech republic Army. Contractual obligations, foreign missions, relationship to North Atlantic Alliance, etc.)

Abstract:

Úvodní kapitola je zaměřena na ozbrojené síly ČR a jejich jednotlivé složky, kde je vymezen pojem „ozbrojené složky“ a zařazení do správně právního postavení ozbrojených sil v systému institucí v ČR. Druhá kapitola se bude týkat analýzy právní úpravy ozbrojených sil ČR. Zde se zaměříme na rozčlenění mezi ústavní zákony, zákony, vyhlášky ministerstev a další podzákonné právní předpisy. Následující, v pořadí třetí kapitola je věnována samotnému postavení Armády ČR, která podrobněji hodnotí postavení Armády ČR v našem státě a jednotlivé vztahy, které má nejen k Evropské unii, ale také k Severoatlantické alianci. Dalším bodem jsou smluvní závazky a zahraniční mise Armády České republiky. V jedné z dalších částí této práce bude přiblížena otázka vrchního velitele ozbrojených sil, tedy prezidenta republiky. Konkrétněji se zde zaměříme na obecná práva a povinnosti vrchního velitele ozbrojených sil a dále také na jeho vztah k Armádě ČR. Předposlední kapitola je věnována Severoatlantické alianci. Závěr této práce bude patřit porovnání ozbrojených sil České a Slovenské republiky, kde jsou analyzovány jednotlivé změny v obou zemích od jejich samostatného vzniku v roce 1993.

Abstract:

The introductory chapter focuses Armed Forces and their individual sections, where the definition of "armed forces" and position in the system of administrative law institutions in the country. The second chapter will cover the analysis of the regulation of the Armed Forces. Here we focus on the breakdown of the constitutional laws, statutes, ordinances ministries and other secondary legislation. Next, in the third charter is devoted to the position of the Czech Army, which assesses in detail the position of the Czech Republic Army in our state and the individual relationships that not only the European Union but also to NATO. Another point will be contractual obligations and foreign missions of the Czech Republic Army. In another part of this work will be zoomed question the Commander in Chief of the Armed Forces, that is the President of the Czech Republic. More specifically, the focus here is on the general rights and duties of commander in chief of the armed forces as well as on its relationship to the Czech republic. The penultimate chapter is dedicated to the North Atlantic organization. The conclusion of this work will be compared to the Armed Forces of the Czech and Slovak Republic, where we analyze various changes in both countries since their very beginning in 1993.
