Arbitrator's Impartiality and Independence in the Czech and Austrian Law - Comparative Study
Abstract:
Cílem této diplomové práce je srovnání institutů nestrannosti a nepodjatosti v české a rakouské právní úpravě a následné vyhodnocení shod a rozdílů. Práce se v obecné rovině zabývá i základní charakteristikou rozhodčího řízení a osobou rozhodce. Řešena je také aktuální problematika appointing authority. Stěžejní části jsou věnovány analýze znaků charakterizující nestrannost a nepodjatost.
Abstract:
The aim of this work is to compare institutes of impartiality and bias in the Czech and Austrian legislation and the subsequent evaluation of similarities and differences. This work working with insludes basic characteristics of arbitration and the arbitrator person. Solution is also the current issue of appointing authority.
