Consumer Protection in the European Union by Way of Examples from Spain

Abstract:

Práce pojednává o ochraně spotřebitele v Evropské unii, přičemž vychází z klíčové charakteristiky této unijní politiky, totiž sdílené pravomoci, která se v oblasti ochrany spotřebitele uplatňuje mezi Evropskou unií a členskými státy. Jako reprezentant členských států bylo vybráno Španělské království. Cílem je zhodnotit roli národního státu a Evropské unie ve spotřebitelské politice a rozdělení pravomocí mezi oběma subjekty. První část práce popisuje vývoj komunitární politiky ochrany spotřebitele od počátků v 70. letech 20. století po současnost. Druhá část analyzuje šest soudních případů ze španělského prostředí, na nichž je demonstrován rozsah pravomocí Evropské unie a národního státu. Práce dochází k závěru, že ve věci ochrany spotřebitele nelze mezi kompetencí Evropské unie a národního státu vždy jednoznačně rozlišovat a že pravomoci ve většině případů náleží orgánům členského státu, které však různými způsoby zohledňují unijní legislativu.

Abstract:

The Bachelor Thesis deals with consumer protection in the European Union. It is based on the key feature of this EU policy, namely the shared competence, which is applied between the European Union and the Member States in the field of consumer protection. The Member States are represented by Spain. The aim of the Thesis is to assess the role of the Member State and the European Union in the consumer policy, as well as the division of the competences between the two subjects. The first part of the Thesis describes the evolution of the EU consumer policy from its origin in the 1970s to the present day. The second part analyses six examples of court cases from Spain, which are used to demonstrate the range of competences of the European Union and the Member State. The Thesis comes to the conclusion that in the area of consumer protection it is usually not possible to clearly differentiate between the competences of the European Union and the Member State and that in most cases the competences pertain to the authorities of the Member State. Nontheless, these take into account the EU legislation in various ways.
