Comparison regulations and supervision in Europe to the USA

Abstract:

Tato diplomová práce se zabývá vývojem regulace a dohledu v oblasti kapitálové přiměřenosti a ratingových agentur v Evropě a ve Spojených státech amerických a jejich změnami v reakci na finanční krizi. První kapitola se zabývá obecně regulací a dohledem a systémy regulace a podobami institucionálního uspořádání dohledu. Druhá kapitola pojednává o předkrizové podobě regulace a dohledu, nejprve se věnuje institucionálnímu uspořádání dohledu v Evropě a v Americe a poté Basel I a Basel II a jejich rozdílné implementaci v Evropě a Americe. Ve druhé kapitole je rovněž rozebrána podoba regulace ratingových agentur. Třetí kapitola nastiňuje problematiku finanční krize obecně a následně se věnuje průběhu, příčinám a reakcím na globální finanční krizi. Celé čtvrtá kapitola je zaměřena na změnu regulace a dohledu po globální finanční krizi. Věnuje se novým Basilejským dohodám a jejich rozdílné implementaci v Evropě a Americe. Následně rozebírá změny v regulaci ratingových agentur. Závěr obsahuje shrnutí a porovnání získaných poznatků ohledně regulace a dohledu v Evropě a ve Spojených státech.

Abstract:

The theme of this diploma thesis is the development of regulations and supervision in the area of capital adequacy and rating agencies in Europe and USA and their changes in a response to the global financial crisis. The first chapter broadly deals with regulations and supervision and systems of regulation and forms of institutional arrangements. The second chapter devoted to regulations and supervision before the crisis. It starts with institutional arrangements of supervision in Europe and in the USA and then addresses Basel I and Basel II and their different implementation in Europe and the USA. The second chapter also analyses rating agency regulations. The third chapter generally outlines and describes progress, causes and responses to the global financial crisis. The fourth chapter deals with changes to regulations and supervision after the global financial crises. The first part of this chapter describes the new Basel accords and their different implementation in Europe and the USA. The second part describes rating regulation changes. The conclusion of this work is a summary and comparison of acquired knowledge about regulations and supervision of financial market in Europe and in USA.
