The Bank Guarantees as the Security for Business Transactions

Abstract:

Bakalářská práce „Bankovní záruky jako zajištění obchodních operací“ obecně charakterizuje bankovní záruky, její členění a fungování a také seznamuje s jejich využíváním v praxi. Hlavním cílem bakalářské práce je prezentace využití bankovních záruk v České republice, vysvětlení jejich používání a také prezentace konkrétního obchodního případu. Práce je rozdělena do čtyř kapitol. První kapitola obecně charakterizuje bankovní záruku a dále se zabývá členěním a popisem bankovních záruk. Druhá kapitola se zabývá právní úpravou bankovních záruk a je převážně zaměřena na zajištění pohledávek, plnění ze záruky, její právní vymáhání a zánik bankovní záruky. Třetí kapitola popisuje rizika spojená s vydáváním bankovních záruk a uvádí konkrétní pokusy o zneužití tohoto platebního instrumentu v obchodním styku. Ve čtvrté kapitole popisuji konkrétní obchodní případ poskytnutí bankovní garance klientovi. Závěrem tato práce vyúsťuje v doporučení komerčním bankám, jak nastavit v současné době politiku financování a klientům, aby byli schopni prezentovat v kvalitní formě svoje podnikatelské záměry a vyvarovali se chyb při jednání s bankami o financování.

Abstract:

The Bachelor thesis „The bank guarantees as the security for business transactions“ generally specifies the bank guarantees, its structure and functioning and acquaintes with their use in practice. The main target of this thesis is to present the using of the bank guarantees in the Czech republic, explanation of their use and presentation of a particular business case. The work is devided into four chapters. The first chapter generally describes the bank guarantee and also examines the breakdown and description of bank guarantee. The second chapter deals with the law of the bank guarantees and is primarily intended to ensure the claims under the guarantee, the law enforcement and termination of the bank guarantee. The third chapter describes the risks associated with the issuance of bank guarantess and owes a practical attempts to exploit this payment instrument in regular trade. The fourth chapter describes the specific business case of a bank guarantee issued to the client. In conclusion, this thesis results in recommendations to commercial banks, how to set in the present funding policy and for clients to be able to present yourself in good form their business goals and avoid mistakes in dealing with banks for lending.
