The issue of investigating cyberbullying among children and youth

Abstract:

Kyberkriminalita je jedním z nejvýraznějších fenoménů dnešní doby a postupně se stává jedním z nejrozšířenějších druhů kriminality. Jsou vůči ní nejzranitelnější zejména dvě složky obyvatel - mládež a důchodci. Jednou z těchto skupin jsou již zmíněné děti a mladiství, kdy tito zaujímají v průběhu vyšetřování trestných činů status zvlášť zranitelné oběti. Prvním orgánem, s kterým přichází poškozená oběť do styku je Policie České republiky. S obětí provádí prvotní a neopakovatelné úkony spojené s příjmem oznámením. Mezi tyto úkony patří: sepsání úředního záznamu o podání vysvětlení s poškozenou osobou, zajištění datových stop týkajících se komunikace mezi poškozeným a pachatelem, zahájení úkonů trestního řízení a následné vyšetřování nahlášené události. Při příjmu události na policii a následně i po celou dobu vyšetřování případu je důležité na prvním místě myslet na oběť a její zranitelnost a vyvarovat se situacím, které by mohly způsobit její druhotnou viktimizaci. Při zvolení vhodných postupů v kombinaci s důsledností a empatií je možné vytvořit pro potřebné úkony takové prostředí, ve kterém se hrozba druhotné viktimizace ze strany orgánu moci k oběti stává co nejnižší.

Abstract:

Cybercrime is one of the most significant phenomena of modern times and gradually becomes one of the most widespread types of crime. The most vulnerable populations to it are particularly two groups – youth and the elderly. One of these groups consists of the aforementioned children and adolescents, who during the investigation of criminal offenses are classified as especially vulnerable victims. The first authority the damaged victims comes into contact with is the Police of the Czech Republic. They perform initial and irreplaceable tasks associated with receiving the report. These tasks include drafting an official record of statements with the injured person, securing data traces related to communication between the victim and the perpetrator, initiating criminal proceedings, and subsequent investigation of the reported incident. When receiving the report at the police station and throughout the investigation of the case, it is important to to prioritize the victims and their vulnerability, and to avoid situations that could cause their secondary victimization. By choosing appropriate procedures combined with consistency and empathy, it is possible to create an environment for necessary tasks in which the threat of secondary victimization by the authority to the victim in minimized.
