Concept and Register of Ultimate Beneficial Owners

Abstract:

Diplomová práce se zaměřuje na problematiku konceptu institutu sku-tečného majitele a evidence skutečných majitelů. Koncepci institutu skutečného majitele autor rozebírá zejména v kontextu obecně přijímaných základních pilířů tohoto institutu položených Financial Action Task Force, se zaměřením na právní úpravu obsaženou v zákoně č. 37/2021 Sb., o evidenci skutečných majitelů. V rámci rozboru právní úpravy evidence skutečných majitelů se autor zaměřuje na popis zá-kladních atributů povahy této evidence dle současné a budoucí právní úpravy a na možnost přístupu k údajům v ní obsažených.

Abstract:

The thesis focuses on the issue of the concept of ultimate beneficial owner and registers of ultimate beneficial owners. The concept of beneficial owner is discussed by the author in the context of the generally accepted fundamental pillars of this institute laid down by the Financial Action Task Force, while focussing on the legislation contained in Law No 37/2021 Coll., on the register of beneficial owners. In the analysis of the legislation on the register of beneficial owners, the author focuses on describing the essential attributes of the nature of that register under current and future legislation and the possibility of accessing the data contained therein.
