The Rights from Defective Performance in B2C

Abstract:

Tato diplomová práce se zabývá právy z vadného plnění ve spotřebitelských vztazích, a to jak obecnou úpravou vadného plnění, tak i vadným plněním z kupní smlouvy a ze smlouvy o dílo. Cílem práce je analyzovat právní úpravu vadného plnění a práv z vadného plnění ve vztazích B2C v občanském zákoníku se zohledněním směrnice 99/44/ES a vymezit pojmy související se spotřebitelským vztahem a to i s ohledem na ustálenou judikaturu. V práci je pozornost věnována rozlišení práv z vadného plnění podle okamžiku existence vady a jsou v ní zakomponovány spory spotřebitelů, se kterými se autorka setkala během praxe ve Sdružení obrany spotřebitelů - Asociace, z.s.

Abstract:

This diploma thesis focuses on rights from defective performance in consumer relationships, both general regulation of defective performance, as well as defective fulfilment of the Purchase agreement and of the Contract for work. The aim is to analyse legislation of the defective performance and the rights of defective performance in B2C relations in the Civil Code, taking into account Directive 99/44/ES and define terms related to consumer relationship also with regard to the consistent jurisprudence. The attention is paid to distinction of the rights from defective performance by the time the existence of defects and there are incorporated consumers disputes with which author came across during the internship at Consumer Protection Association - Association z.s.
