Hedge Command – Law and Economics Aspects

Abstract:

Diplomová práce je zaměřena na problematiku zajišťovacích příkazů v systému daně z přidané hodnoty. Cílem této práce je zhodnotit používání zajišťovacích příkazů finanční správou, a to z pohledu související právní úpravy, z ekonomického pohledu a rovněž i z pohledu vlastní činnosti správce daně. Činnost finanční správy v této oblasti byla zásadním způsobem ovlivněna judikaturou Nejvyššího správního soudu. Jeden ze zásadních rozsudků ze dne 7. 1. 2016 ve věci Českomoravská olejářská komanditní společnost změnil dosavadní interpretaci ustanovení daňového řádu, týkající se pojmu dobytnost daně. Mimo rovinu platební totiž soud nově akcentoval i rovinu přiměřené pravděpodobnosti, že daň bude v budoucnu stanovena. V této souvislosti je ověřována hypotéza, dle které správce daně není schopen naplnit požadavek soudu na prokázání přiměřené pravděpodobnosti budoucího stanovení daně z přidané hodnoty. Za použití metod analýzy, dedukce a syntézy došlo k vyvrácení hypotézy. Při vydání zajišťovacího příkazu má správce daně problémy (kromě procesních pochybení) především ve zdůvodnění obavy o budoucí dobytnost či vymahatelnost daně. Tato skutečnost je následně předmětem úvah de lege ferenda. Výsledkem těchto úvah je návrh nového právního institutu v podobě zajišťovacího dozoru.

Abstract:

The diploma thesis deals with the issue of hedge commands in the value added tax system. The goal of the thesis is to evaluate the use of hedge commands by the Financial Administration regarding the related legal regulation, the economic point of view as well as the activities of the tax administrator. The activities of the Financial Administration in this field were affected significantly by the judicial decisions of the Supreme Administrative Court of the Czech Republic. One of the material judgments of 7 January 2016 in the case of Českomoravská olejářská komanditní společnost changed the previous interpretation of the tax rules concerning the term of tax recoverability. Actually, in addition to the payment level, the court also accented the level of reasonable probability that the tax will be determined in the future. In this connection, a hypothesis, according to which the tax administrator is not able to meet the court´s request to prove the reasonable probability of the future determination of the tax, is tested. Using the methods of analysis, deduction and synthesis, the hypothesis was disproved. In issuing a hedge command, the tax administrator has problems (except for procedural malpractice) mainly in the justification of the concern about the future recoverability or enforceability of the tax. This fact is then the subject-matter of de lege ferenda considerations, which result in a new draft of a legal institute in the form of hedging supervision.
