The Issue of Time Limits in Paternity Matters

Abstract:

Tato diplomová práce se zabývá problematikou lhůt v paternitních věcech. Jedním z problémů řešených v této práci je i samotný charakter lhůt pro popírání otcovství – tedy úvaha o tom, zda se ve vazbě na § 654 občanského zákoníku jedná o lhůty promlčecí či prekluzivní. Cílem práce je dále představení současné právní úpravy této problematiky, zohledňující aktuální vnitrostátní i evropské trendy, a to v komparaci s úpravami předchozími. Na základě těchto informací práce následně právní úpravu a její změny hodnotí a představuje úvahy de lege ferenda.

Abstract:

This diploma thesis is dealing with the issue of time limits in paternity matters. One of the main problems addressed in this thesis is also the character of the time limits given for the denial of paternity – thus consideration if the time limits in the relation with § 654 of the Czech Civil Code are statutory bars or lapses of claims. The aim of this thesis is also presentation of the current legal regulation of this issue, involving the recent national and European trends, in comparison with the previous legal regulations. On this basis the thesis then assesses the regulation and its changes and presents the de lege ferenda ideas.
