Subjekty soukromoprávních vztahů s mezinárodním prvkem si mohou sjednat, že jejich spor bude projednán před rozhodci, nebo před národními soudy konkrétně zvoleného státu. V praxi tak nezřídka dochází k uzavírání dohod o volbě sudiště (rozhodčích a prorogačních smluv), jež jsou upraveny instrumenty na mezinárodní, evropské i národní úrovni.
