Damages for unlawful decision

Abstract:

The theme of my baccalaureate labour is the compensation of the damage caused by an unlawful decision. Its very necessary to bring near to the laic public the problem of the responsibility, and of course compensation of the damage, to analyse this problem. This is the main reason, why we dissect the responsility in general level in our first chapter. In this chapter we briefly define types of the responsabily, subjects of the responsability and the origins of the responsability. Extraordinary attention is paid to the responsability for damages caused by the organs of public authority. Its the specific type of the state responsability, which is contained in law number 514/2003 Z. z. about the responsability for the damage caused by practising the state authority. Breaking the law norms of Slovak republic from the state part, takes for the consequence an anacceptable and unwished phenomenon. And the law about the responsability for the damage caused by practising the state authority, determines certain rules, which lay out conditions and the way of compensation this damage for unlawful decision- which we describe in several chapters.

Abstract:

Témou bakalárskej práce je náhrada škody za nezákonné rozhodnutie. Na to aby sme mohli hovoriť o náhrade škody je nutné sa povenovať a priblížiť laickej verejnosti problematiku zodpovednosti a náhrady škody. Z daného dôvodu v prvej kapitole popisujeme zodpovednosť na všeobecnej úrovni, kde v krátkosti opisujeme druhy zodpovednosti, subjekty zodpovednosti ako aj vznik zodpovednosti. Zvláštnu pozornosť venujeme zodpovednosti za škody, ktorá je spôsobená orgánmi verejnej moci. Jedná sa o špecifickú zodpovednosť štátu., ktorá je obsiahnutá v zákone č. 514/2003 Z. z. o zodpovednosti, za škodu spôsobenú pri výkone verejnej moci. Porušením právnych noriem Slovenskej republiky zo strany štátu pri výkone verejnej moci dochádza k nežiaducemu a k neprijateľnému spoločenskému javu. A práve zákon o zodpovednosti za škodu spôsobenú pri výkone verejnej moci stanovuje presné pravidlá, ktoré upravujú podmienky a spôsob náhrady škody za nezákonné rozhodnutie , ktoré popisujeme v niekoľkých kapitolách .
