Civil law relationship between neighbours

Abstract:

This bachelor thesis deals with the relationships that arise between neighbours, defines them, describes immissions, which occur most commonly between owners of properties, analyzes protection of relationships between neighbours and indicates law in question of immissions. The first chapter is focused on the civil law relationship, on the subject, object and content of this relationship. Devoting the second chapter to the definition of relationships and rights between neighbours, bachelor thesis characterizes right to property and analyzes various properties, which are object of relationships between neighbours too (e. g. land, building). Modification of specific relationships between neighbours according to Civil Code is treated in the third chapter, especially on immissions. Attention is focused on the question of the fence and to the access to neighbouring land. The fourth chapter describes the protection of neighbour’s rights by self-help and the protection in trial. Three types of accusations are elaborated. The actually decision-making activity of courts is presented in the fifth chapter. Bachelor thesis shows past judgments in a variety of immission cases, which could arise between neighbours.

Abstract:

Bakalárska práca sa zaoberá vzťahmi, ktoré vznikajú medzi susedmi, vymedzuje ich, charakterizuje imisie, ktoré sa najčastejšie vyskytujú medzi majiteľmi susediacich nehnuteľností, analyzuje ochranu susedských práv a uvádza judikatúru v otázke imisií. Prvá kapitola je zameraná na občianskoprávny vzťah, na subjekt, objekt a obsah tohto vzťahu. Druhá kapitola sa venuje vymedzeniu susedských vzťahov a práv, charakterizuje vlastnícke právo, ktoré je dôležitým aspektom, ďalej analyzuje nehnuteľnosti, ktoré sú objektom susedských práv (napr. pozemok, stavba). Tretia kapitola je orientovaná na úpravu konkrétnych vzťahov medzi susedmi podľa Občianskeho zákonníka, najmä na imisie. Pozornosť je venovaná i oploteniu a vstupu na pozemok suseda. Štvrtá kapitola zachycuje ochranu susedských práv svojpomocou a ochranu v súdnom konaní, sú tu rozpracované tri druhy žalôb. Na aktuálnu rozhodovaciu činnosť súdov je zameraná piata kapitola, uvádza rozsudky hlavne vo veciach imisií, ktoré môžu medzi susedmi vznikať.
