The Constitutional Limits of Criminal Regulation of Extremist Speech

Abstract:

Tato diplomová práce se zabývá trestněprávní regulací extremistických projevů, především pak jejími ústavními limity. Nejprve teoreticky vymezuje pojem extremistické projevy a poté popisuje dotčené skutkové podstaty z trestního zákoníku. Její hlavní náplní však je vymezení pojmu svobody projevu a jejího možného omezení, především ve vztahu k nenávistným projevům. Také popisuje koncept militantní demokracie, který je dle autora východiskem možného omezení svobody projevu a porovnává ho s liberálním přístupem k občanským svobodám, jenž je uplatňován ve Spojených státech. Závěrem potom srovnává českou trestněprávní regulaci extremistických projevů s jinými evropskými legislativami co do šíře i přísnosti.

Abstract:

This thesis deals with the criminal regulation of extremist speech, especially with constitutional limits of this regulation. At first, it theoretically defines concept of extremist speech and then it describes relevant criminal offenses from the Criminal Code. This thesis is primary focused on describing freedom of expression and its possible limitations, mainly in respect to hate speech. It also describes concept of militant democracy, that is acording to author the basis of possible restrictions on freedom of expression. Furthermore, it compares militant democracy with liberal approach of United States to civil liberties. At the end, there is comparation of the Czech criminal regulation with other European legislations in the terms of scope and rigor.
