"Superficies solo cedit" principle - current státe and perspectives
Abstract:
V souvislosti s účinností nového občanského zákoníku se po více než padesáti letech do české právní úpravy vrací i zásada „superficies solo cedit“. Práce zjišťuje, z jakých důvodů a jakým způsobem se zásada naplňovala a uplatňovala v předchozím občanském zákoníku (zákon č. 40/1964 Sb.) a jaký je její současný stav a perspektivy. Podrobněji se zabývá institucemi jako jsou věc, pozemek a stavba.
Abstract:
This Bachelor thesis deals with principle „superficies solo cedit“ – its current status and perspectives. The aim is to find, how principle is asserted in Civil Code (No. 40/1964 Coll.) and what will change with upcoming new regulation of Civil Code. New Civil Code was inured on 1st January 2014 and accept principle „superficies solo cedit“ after more than fifty years again.
