Comparative Analysis of Fighting Against Human Trafficking in the Czech and Slovak Republics

Abstract:

The diploma thesis focuses on the fighting against human trafficking in the Czech and Slovak Republics. On the whole, only a limited attention is dedicated to this topic in both countries, in particular to its human rights aspect. The aim of this thesis is to examine relations between the state and the non-governmental sector in fighting against human trafficking. Moreover, strategies of the different actors are analysed. The thesis offers a theoretical account of both the trafficking in human beings and the attributes of the non-governmental sector. The analysis is based on qualitative comparative case studies of the Czech and Slovak Republics, accompanied by a detailed description of state and non-governmental approaches to the problematic. Furthermore, a cooperation between the republics is studied. The results of the analysis show that the motivation of a state to comply with international treaties is not necessarily tied to the ratifications thereof. This aspect can be observed in both countries, whereas the Czech Republic is more active in fighting against human trafficking than Slovakia despite a prolonged process of ratification of adoption of the treaties in question. I conclude that the activities are more evenly divided among the respective sectors in the Czech Republic than in Slovakia. However, the predominant dynamic of the relation between the state and the non-governmental organisations is that of cooperation in comparison to confrontation. In addition, the results indicate that states primarily focus on security, while the non-governmental sectors concentrate on the human rights aspect of the topic.

Abstract:

Diplomová práca je zameraná na skúmanie boja proti obchodovaniu s ľuďmi v Českej a Slovenskej republike. Tejto problematike nie je v oboch krajinách venovaná dostatočná pozornosť, a to najmä jej ľudskoprávnej rovine. Cieľom tejto práce je analyzovať vzťahy medzi štátom a neziskovým sektorom v boji proti obchodovaniu s ľuďmi. Zároveň diplomová práca skúma zameranie aktérov na jednotlivé roviny problému. Diplomová práca popisuje teoretické pozadie obchodovania s ľuďmi a atribútov neziskového sektora. Analýza je vypracovaná na základe kvalitatívnej komparatívnej štúdie Českej a Slovenskej republiky prepojenej s detailným popisom prístupu štátnych orgánov a neziskového sektora k boju proti obchodovaniu s ľuďmi. Skúmaná je aj spolupráca medzi oboma republikami. Výsledky výskumu preukázali, že motivácia štátu konať v súlade s medzinárodnými zmluvami nie je nutne spojená s ich ratifikáciou. Tento aspekt sa prejavil v oboch skúmaných krajinách, pričom Česká republika je na rozdiel od Slovenska aktívnejšia v boji proti obchodovaniu napriek zdĺhavému procesu prijímania zmluvných záväzkov. V Českej republike možné pozorovať rovnomernejšiu mieru rozdelenia činnosti medzi štát a neziskový sektor ako na Slovensku. Avšak, v oboch krajinách spolupráca medzi štátnym a neziskovým sektorom prevažuje nad ich súperením. Zároveň výsledky analýzy naznačujú, že štátne sektory sú viac zamerané na bezpečnostnú rovinu, pričom neziskové organizácie sa sústreďujú primárne na ľudskoprávnu rovinu problematiky.
