Abstract:

Tato práce se zabývá problematikou, jež je vyvolána nedostatečnou právní úpravou v oblasti prostituce a kuplířství. V prvé řadě je provedena analýza historické i platné právní úpravy na území České republiky i v zahraničí. Následně jsou vymezeny modely přístupů států k regulaci prostituce a jevů s ní souvisejících. Dále se práce zaměřuje na rozbor judikatury, díky níž poukazuje na až absurdní situace vyvolané absencí právní úpravy. Na závěr poskytuje nástin vhodné právní úpravy v oblasti dobrovolné prostituce, jenž se týká zejména prostitutek a kuplířů.

Abstract:

This thesis focuses on the problem caused by the aforementioned insufficient legislation on prostitution and the pimping and pandering law. The first part of the work analyzes the historical and contemporary legislation related to this topic both in the Czech Republic and abroad. Afterward, models of regulation of prostitution and related phenomena are introduced. The work also contains an analysis of the Czech case law, which helps to identify the divergent views of the courts and to point out the absurd situations caused by the lack of applicable law. Last but not least, de lege ferenda considerations are introduced in the thesis, being focused on prostitution, pimping, and pandering.
