Abstract:

Práce je rozdělena do čtyř hlavních celků, které popisují proces vzniku Lisabonské smlouvy od jejich počátečních úvah a snah upravit primární právo unie až po její přijetí ve všech členských státech Unie. První kapitola je zaměřena na okolnosti, které vedli k vytvoření Evropské ústavy. Společenství vědomo si nutnosti provedení změn vyzvalo široké spektrum respondentů o zapojení do diskusí o budoucnosti Unie. Laekenská deklarace shrnula dosavadní úspěchy a předestřela ve svých výzvách oblasti a otázky, které mají být řešeny. Pro hledání odpovědí a vytvoření návrhů byla vybrána forma Konventu. Vyústěním byl návrh Evropské ústavy, kterou se nepodařilo prosadit. Druhá kapitola obsahuje období reflexe a hledání přijatelnějšího způsobu řešení. Německé předsednictví si předsevzalo obnovit tento proces a pokusit se prosadit návrh, který by lépe korespondoval s představami jednotlivých členů. Úpravou původního návrhu a konzultacemi se podařilo předložit nový návrh v podobě Lisabonské smlouvy. Proces a způsob ratifikace je detailně zpracován. Třetí kapitola se věnuje jednotlivým ustanovením smlouvy. Odráží demokratické a transparentní prvky v podobě posílené role Evropského parlamentu, úlohu vnitrostátních parlamentů a občanské iniciativy. Čtvrtá kapitola popisuje vybrané hlavní instituce Unie ve vztahu k jejich funkci a pravomocem. Doplňuje tak předchozí kapitolu, aby bylo dosaženo ucelenějšího přehledu o jejich činnosti.

Abstract:

The thesis is divided into four major chapters which describing the proces of the Lisabon Treaty from the initial considerations and efforts to adjust the primary right of the Union after its adoption in all member States of the Union. The first chapter focuses on the circumstances that led to the creation of a European Constitution. Community aware of the need to implement changes called for a wide range of respondents to engage in discussions on the future of the Union. Laeken Declaration summarized the achievements and challenges opened up in their areas and issues to be addressed. To find answers, and develop proposals were selected through a Convention. Closing of the draft European Constitution, which failed to enforce. The second chapter contains a period of reflection and more acceptable way of finding solutions. The German presidency has resolved to renew the process and try to push through a proposal that would have better corresponded with the wishes of individual members. Modification of the original proposal and managed to place an submit a new proposal in the form of the Lisbon Treaty. Ratification process and how it is treated in detail. The third chapter is devoted to the provision smlovy. Reflected the democratic and transparent elements in the form of enhanced role of the European Parliament, the role of national parliaments and civil society initiatives. The fourth chapter also describes the main institutions of the Union in relation to their functions and powers. It complements the previous chapter, in order to achieve a fuller picture of their activities.
