Copyright law and its protection in music industry

Abstract:

Diplomová práce se v první části zabývá rozborem pojmů duševní vlastnictví, dílo, hudební dílo a autor. Duševní vlastnictví je definováno s pomocí několika mezinárodních úmluv a poté je uvedeno jeho rozdělení. Poté je demonstrativním výčtem definován pojem dílo, tak jak uvádí Bernská úmluva, nebo český autorský zákon. Samostatně je definováno i dílo hudební. V rámci rozebírání pojmu autor díla jsou rozebrány také některé pojmy s tímto související a to, anonym a pseudonym, majetková práva a osobnostní práva. Druhá část této práce se zabývá stěžejním tématem této práce a to ochranou práv k hudebním dílům. Nejdříve je však vymezen zásah do práv do autorských práv a prostředky k ochraně proti takovému zásahu. V rámci této části se práce zabývá také kolektivní správou. V návaznosti na to se práce zabývá kolektivními správci v česku, jejich právy a povinnostmi, a také vztahem mezi nimi a nositeli práv. V rámci tématu ochrany autorských práv je rozebrána Směrnice Evropského parlamentu a Rady (EU) 2019/790 o autorském právu a právech s ním souvisejících na jednotném digitálním trhu, která má na ochranu autorských práv vliv. Třetí část této práce je podrobněji zaměřena na dva české kolektivní správce, a to na OSA a INTERGRAM. Oba tyto spolky jsou rozebrány co do jejich činností, tak organizační struktury. Také jsou objasněny rozdíly mezi nimi a rozdíly v rozsahu práv, které spravují. V rámci OSA se práce zabývá problematikou Licence pro více území k právům k užití hudebních děl online, jelikož OSA je zatím jediným kolektivním správcem, který může takové licence udělovat. Část čtvrtá této práce slouží k porovnání české a zahraniční právní úpravy autorských práv. Porovnáváno s Českou republikou je Německo a Spojené státy americké. Závěrečná část práce je věnována tématu hudební pirátství. Nejdříve je tento pojem vysvětlen a poté se práce zabývá příčinami rozšíření hudebního pirátství a reakcí práva a korporací na toto rozšíření. Součástí této části práce je také rozebrání dvou judikátů s tímto tématem souvisejících a to judikátů nazývaných Napster a Hellshare/Hellspy.

Abstract:

The first part of the thesis deals with the analysis of the concepts of intellectual property, work, musical work and author. Intellectual property is defined with the help of several international conventions. Then, the term work is defined by a demonstrative list, as stated in the Berne Convention or the Czech Copyright Act. A musical work is defined separately. As part of the analysis of the term author of the work, some related terms are also discussed, namely, anonymous and pseudonym, property rights and personal rights. The second part of this thesis deals with the main topic of this work, the protection of rights to musical works. First, however, the infringement of copyright and the means of protection against such infringement are defined. In this part, the thesis also deals with collective management. In connection with this, the thesis deals with collective administrators in the Czech Republic, their rights and obligations, as well as the relationship between them and rightholders. Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market, is discussed in the context of copyright protection. The third part of this thesis is focused in more detail on two Czech collective administrators, namely OSA and INTERGRAM. Both are analyzed in terms of their activities and organizational structure. The differences between them and the scope of the rights they administer are clarified. Within OSA, the thesis deals with the issue of licenses for multiple territories for the rights to use musical works online, as OSA is so far the only collective administrator that can grant such licenses. Part four of this thesis is used to compare Czech and foreign copyright law. The law of the Czech Republic is compared to the law of Germany and the United States. The final part is devoted to the topic of music piracy. First, this concept is explained and then the thesis deals with the causes of the spread of music piracy and the reaction of law and corporations to this expansion. Part of this thesis is also an analysis of a case law, namely cases called Napster and Hellshare/Hellspy.
